Kendrick Trade (“Kendrick Trade,” “we,” “our,” or “us”) respects your privacy and is committed to protecting it by complying with this privacy notice (“Privacy Notice”). KendrickTrade is an automated qualification analysis support tool for US-Mexico-Canada’s free trade agreement (USMCA) where Kendrick Trade improves accuracy, generates documentation, and reduces costs with the streamlined features. This Privacy Notice describes the type of information we may collect; who we may collect it from; and our practices for collecting, using, maintaining, protecting, and disclosing that information when you visit our (“Site”) or in connection with the services available on the Site (Site and services collectively, the “Offerings”).

Capitalized terms that are used but not defined in this Privacy Notice have the meaning given in our Terms of Service

Please read this Privacy Notice carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, you have the choice to not to use any of our Offerings. By accessing or using our Offerings, you agree to this Privacy Notice and consent to the collection and processing of your information as described in this Privacy Notice. This Privacy Notice may change from time to time. Your continued use of our Offerings after we make changes is deemed to be acceptance of those changes, so please check the Privacy Notice periodically for updates. This Privacy Notice applies to information we collect:
- On this Site, including when you or your authorized representative(s) access or use the Offerings;
- When you interact with our advertising on third party websites;
- In email, text, and other electronic messages between you and us; or
- When you interact with our Offerings on third-party websites.

It does not apply to information collected by:
- a third-party;

We may collect several types of information from and about users of our Site, including:
- information by which you may be personally identified such as name, email, phone number, physical address, or any other information which could be associated with orused to identify you (“personal information”);
- User Data as defined in our Terms of Service or any other information you upload to our Offerings including through a CSV file;
- your physical features if you upload a photo of yourself to your account;
- any other information you provide in the body of your inquiry on our contact us page;
- technical information about your internet connection, the equipment you use to access our Offerings, including usage details and IP addresses;
- details of your visits to and usage of our Offerings including traffic data, logs, and other communication data and the resources that you access and use on the Offerings; or
- login information such as username and password.

To complete a transaction, you may be required to provide information such as the type of card, card number, expiration date, security code, and billing address. When you provide such information, it is processed directly by a third-party payment processor. We do not have direct access to, process, transmit, handle, or store any of your credit or debit card details.

We collect this information:
- directly from you when you provide it to us; or4
- automatically as you access or navigate through the Offerings through automated data technologies such as through cookies and other tracking technologies.


The information we collect on or through our Site may include:
- information that you provide by filling in forms on our Site, including information provided at the time of subscribing to our email communication service or requesting further services;
- records and copies of your correspondence (including email addresses) if you contact us, including when you report a problem with our Offerings; or
- your responses to surveys that we might ask you to complete for research purposes.


As you navigate through and interact with our Site, we may use automatic data collection technologies, or other innovative technologies as they come out, to collect certain information about your equipment, browsing actions, and patterns, including:
- details of your visits to our Site, including traffic data, location data, logs, and othe rcommunication data and the resources that you access and use on the Site; or
- information about your computer and internet connection, including your IP address, operating system, and browser type.


We use information that we collect about you or that you provide to us, including any information:

- to present our Offerings and its contents to you;
- to provide you with information, customer service, products, or services you request from us;
- to fulfill any other purpose for which you provide it;
- to provide you with notices about your account, including expirations and renewal notices;
- to carry out our obligations and enforce our rights arising from any contract entered into between you and us, including billing and collection;
- to notify you about changes to our Offerings or any products or services we offer or provide through it;
- any other way we may describe when you provide the information;
- for any other purpose with your consent; or
- to improve our Offerings including our services.


We may disclose information that we collect or you provide as described in this Privacy Notice:
- to contractors, service providers, and other third parties and who keep personal information confidential and use it only for the purposes for which we disclose it to them including our third party payment processor;
- to a third party you direct us to share it with
- to a buyer or other successor in anticipation of or in connection with a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Kendrick Trade’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which information held by Kendrick Trade is among the assets transferred;
- to fulfill the purpose to which you provide it;
- for any other purpose disclosed by us when you provide the information; or
- with your consent.

We may also disclose your information:
- to comply with any court order, law, or legal process, including to respond to any government or regulatory request;
- to enforce or apply our Terms of Use or other agreements, including for billing and collection purposes; or
- if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Kendrick Trade, our users, or others.


We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. We store your information on servers behind firewalls in a data center located in the United States. We use third party service providers such as Amazon Cognito to store your username, password, and email.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Offerings, you are7responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Offerings. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Offerings.


We will keep your personal information for as long as it necessary to provide the Offerings to you. Thereafter, we will keep your personal information for as long as is necessary:
- to respond to any questions, complaints, or claims made by you or on your behalf;
- to show that we treated you fairly; or
- to keep records required by law.

However, in no event do we keep data longer than 5 years total. The first year the data is accessible by you through your account. Thereafter, your information is moved to a secure deep archive for 4 years and deleted 4 years after from the date it is moved to the archive.


We strive to provide you with choices regarding the personal information you provide to us. Below are options for your personal information.


You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Offerings may then be inaccessible or not function properly.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI's website/or other opt out mechanism.

In addition, your mobile device settings may provide functionality to limit our, or our partners’, ability to engage in ad tracking or targeted advertising using the Google Advertising ID or AppleID for Advertising associated with your mobile device.

If you do not wish to receive our marketing emails, you may unsubscribe by following the unsubscribe instructions at the bottom of the email or by contacting through the contact information in the How to Contact Us section at the bottom of this Privacy Notice. You may continue to receive service-related and other non-marketing emails.


You can review and change your personal information by logging into your account and updating your information under the setting page.


Some web browsers (including Safari, Internet Explorer, Firefox and Chrome) incorporate a “DoNot Track” (“DNT”) or similar feature that signals to websites that a user does not want to have his or her online activity and behavior tracked. If a website that responds to a particular DNT signal receives the DNT signal, the browser can block that website from collecting certain information about the browser’s user. Many digital service operators, including Kendrick Trade, do not recognize or respond to DNT signals.


We are not responsible for the practices employed by third party websites, applications, or services linked to or from our Site. We recommend the user review the privacy notices of other third party websites, applications, and/or services applications before authorizing a third-party access to your data.


Our Offerings is not directed at or intended for children under 18 years of age. No one under age18 may provide any information to or on the Site. We do not knowingly collect information from children under 18. If you are under 18, do not use or provide any information on the Site or on or through any of its features/register or in connection with the Offerings. If we learn we have collected or received information from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a9child under 18, please contact us through the information at the How to Contact Us section at the bottom of this Privacy Notice.


If you do not agree to this Privacy Notice or any of our other policies posted here, do not use the Offerings. In our sole discretion, we may revise this Privacy Notice from time-to-time. The Last Updated date is set forth at the top of this page. All changes are effective 15 days after the Last Updated date for current users and immediately for new users. Your continued use of the Offerings following the posting of this Privacy Notice means you accept and agree to the Privacy Notice. Additionally, we may notify you of material changes
